If you are using a non-CLS Terms and Conditions on your website and you use artificial intelligence (“AI”) technology to create any type of content on your website, your email marketing, social media, your imagery, graphics, audio (etc), you must put this in your website terms and conditions.
As the legal landscape changes rapidly in the midst of the explosion of AI, it is critical that you have the proper disclaimer(s) in place for your online business. Through this disclaimer, you will be able to notify users of your website that you may utilize AI tools to generate some content, and are doing so as transparently as possible, but that you cannot be held liable for any errors or omissions.
Most importantly, you are letting users of your website know, in the most transparent manner possible, that the final byproduct is a “human creation” (capable of retaining intellectual property ownership). In other words, users aren’t allowed to copy your website.
