Bringing on a second shooter for your client’s wedding or event is a no-brainer, right? After all, you can’t be everywhere at once, and sometimes that additional perspective makes all the difference.
But…who owns the images they take? How many creative liberties can they take? How much must they align with your brand? When do you know if they’re a contractor or an employee? This contract will cover everything that should be expected of both parties, saving you both from those awkward conversations later on.

Who is entering into the agreement and the purpose of the agreement
On what day, where for how many hours the wedding shoot will take place
If needed, if the primary photographer must provide the second shooter with any materials (eg. camera) in order for them to provide the service
What happens if the second shooter damages the provided materials (eg. camera)
What account access must be shared, and by when (eg. Google Drive, Honeybook, etc.)
Statement that the primary photographer may not control the manner in which the second shooter performs the work
The second shooter retains creative license rights to perform the services with their specialized skill and talent
Date and duration of the services
Price of the second shooter services (hourly or event/package-based)
Policies around travel and the fees associated
What happens in the situation of a late payment
Expectations of the second shooter (ie. behavior, dress code, punctuality, contact and marketing to customers/event attendees, customer billing, photographic standards)
Who owns the copyright and intellectual property rights after the session is complete
Policies governing the second shooters ability or inability to publish the photos online
Statement on the relationship of the parties (ie. the second shooter is an independent contractor, not an employee)
Ability for the second shooter to engage in other business activities
How cancellations and rescheduling would be handled
What happens if the second shooter is incapacitated and unable to perform the services
Standard legal clauses including: confidentiality, representations and warranties, dispute resolution, limitation of liability, merger, notice, force majeure, compliance with law, amendments, assumption of risk and indemnification

This agreement is between you, the primary photographer, and the second shooter.
