So you’ve agreed to design your client’s website, but what have you really agreed to? After you’ve designed their site, how much can they expect you to step in and show them how to use the site? How many changes can they request? When is your job completed?
This contract between you and your web design client will clarify all this and more.

Who is entering into the agreement and the purpose of the agreement
Which package has been chosen, what is included in that package and what deliverables the client may expect to receive at project completion
How many rounds of revisions are included, and the price of additional rounds of revisions if requested
Duration (dates) of the agreement
Fees of the web design package chosen
Methods of payment accepted and payment terms (initial payment, retainer/deposit, final payment, etc.)
What happens if the situation arises of a late payment
Policies on refunds
How cancellations or terminations of the agreement would be handled, and policy on an early termination fee
Statement on the type of relationship of the parties (ie. the web designer is an independent contractor, not an employee of the client)
What materials and access the web designer needs from the client to perform their duties, and by when
Statement that the client accepts if they send deliverables/site content late, the project completion may be late as well
What happens to the initial payment if the client does not get the designer the needed site content on time
Who owns the intellectual property and copyright rights after the contractors work is completed
Option for the client to purchase an extended license
Agreement that both parties have the ability to share photos of the work for marketing and advertising purposes
The web designer retains creative license rights to perform the services with their specialized skill and talent
If the contractor may may be engaged in other business activities which does not place them in a conflict of interest with the client
How cancellations, terminations, and breaches of agreement would be handled
Requirement for the web designer to be reimbursed for time worked if the client terminates the agreement
What happens if the web designer is incapacitated and unable to perform the services
Standard legal clauses, including: Representations and warranties, confidentiality, limit of liability, dispute resolution, amendments, compliance with law, waiver, assumption of risk, indemnification, merger, and force majeure
